—Judgment, Supreme Court, Bronx County (Lawrence J. Tonetti, J.), rendered August 27, 1992, convicting defendant, after a jury trial, of robbery in the first degree, and sentencing him, as a second felony offender, to a term of 6 to 12 years, unanimously affirmed.

Since the record was unclear, we remanded this matter for a hearing to determine whether defendant was present at the Sandoval hearing and held the appeal in abeyance pending such hearing (216 AD2d 16). The hearing was held and apparently there was a bench conference before the Sandoval hearing at which defendant was not present.…
