Appeal from the Circuit Court of Clinton county; the Hon. S. L. Bryan, Judge, presiding. This was a bill for injunction. The bill sets forth that the trustees of the State Bank of Illinois are the owners in fee simple of the south-east quarter of Section 17, Township 2 north, Range 2 west of third principal meridian. That the appellant purchased said land in fee simple on the 26th November, 1862, and received from the trustees a bond for a deed, which is made an exhibit.

On the third day of October, 1835, Thomas Wilton made his promissory note for the sum of four hundred dollars, payable to the president, directors and company of the State Bank of Illinois, with interest, and to secure its payment, executed a mortgage on the premises in controversy.
On the twenty-second day of February, 1848, the bank filed a bill in chancery in the Clinton Circuit Court, to foreclose. he mortgage, against Thomas Wilton and wife.
