This is an appeal from an order of the district court of Okmulgee county denying application for appointment of a receiver by plaintiff in error, who is plaintiff below, in an action to foreclose a mortgage. The order is in the nature of an interlocutory order, but is appealable under the provisions of section 780, O. S. 1931, as amended by section 1, ch. 3, S. L. 1935.

Plaintiff first complains of an order sustaining a motion to quash the summons and service thereof for certain irregularities.
