MEMORANDUM OPINION AND ORDER DISMISSING THIS CHAPTER 13 CASE

MARTIN GLENN, Bankruptcy Judge.

Before the court are two motions to dismiss this chapter 13 case filed by Michael G. Vinieris (‘Vinieris” or “Debtor”). The motions to dismiss were filed by a creditor, Federal Insurance Company (“FIC”), and by the Chapter 13 Trustee, Jeffrey Sapir. FIC contends that it is a judgment creditor with a secured claim of $9,956,955.84, plus interest, and, therefore, the Debtor is not an eligible chapter 13 debtor pursuant to 11 U.S.C. § 109(e), limiting a qualified chapter 13 debtor’s non-contingent,…
