Diana Jelic v. CitiMortgage, Inc.
District Court of Appeal of Florida
1Opinion of the CourtForst, J.
In this foreclosure action, Appellant Diana Jelic appeals the trial court’s entry of final summary judgment in favor of the appellee, CitiMortgage, Inc. Appellant argues the trial court reversibly erred by (1) entering summary judgment despite Citi-Mortgage’s failure to refute her affirmative defenses of unclean hands and failure to satisfy the conditions precedent, and (2) admitting the affidavit in support of the motion for summary judgment. For the reasons stated below, we disagree and affirm the summary judgment of foreclosure.
