ROTH, District Judge:

This action was originally instituted as an action for injunctive relief under Title 42 U.S.C. Section 1983 and Title 28 U.S.C. Section 1343(3) and (4). Pursuant to Title 28 U.S.C. Sections 2281 and 2284 a three judge-court was convened.

Plaintiff Mogk attempted to register as a candidate for the City of Detroit Charter Commission but was rejected by the defendant Edwards, City Clerk of the City of Detroit, Michigan, on the ground that he did not meet the residential requirement of the Michigan Home Rule Act, Mich.Comp.Laws, Section 117.18 (M.S.A.
