MEMORANDUM-DECISION and ORDER
HURD, United States Magistrate Judge.
I. INTRODUCTION
Plaintiff, Richard J. Owens, seeks compensatory and punitive damages for violations of 42 U.S.C. §§ 1981, 1983, 1988, and the First, Fourth, Fifth, Eighth, and Fourteenth Amendments to the U.S. Constitution. The claims arise from plaintiffs arrest on May 11, 1991, for several traffic violations, including driving while intoxicated. The Defendants have moved for summary judgment on all counts of the complaint pursuant to Fed. R.Civ.P. 56. The plaintiff opposes the motion. Oral argument was heard on July 14, 1994.…
