MEMORANDUM OPINION AND ORDER

This State prisoner habeas corpus action pursuant to 28 U.S.C. § 2254 was transferred to the Western District of Missouri on July 30, 1981. The factual circumstances of the offense and proceedings at trial are accurately stated by the Missouri Court of Appeals, Kansas City District, in its opinion affirming petitioner’s conviction on direct appeal in State v.
