OPINION

DONNELLY, Judge.

On appeal, we review two separate orders from the District Court of Roosevelt County, granting summary judgment against different claimants to the estate of M. H. McGrail. Both appeals have been consolidated for hearing before this court.

Appellee Portales National Bank, (Bank), in its capacity as testamentary trustee under the Last Will and Testament of M. H. McGrail, deceased (decedent), filed suit for declaratory judgment seeking construction of decedent’s testamentary trust.
