OPINION

DUNCAN, Judge.

The defendant, Johnny Hemby, was convicted in the Lauderdale County Circuit *924Court of involuntary manslaughter growing out of the death of his five week old son, John Rupert Hemby. He was also convicted of assault and battery upon his former wife, Mary Jane Hemby. The two cases were consolidated for trial, and the defendant received jail sentences of 11 months 29. days in each case, the sentences to be served consecutively.
