ORDER AND OPINION 1

MORGAN, District Judge.

This matter comes before the Court on the Defendant’s Motion to Dismiss the in dictment. The Motion was filed on September 24, 2002 and the Government’s Opposition Brief was filed on September 26, 2002. The Court held a hearing on the motion prior to commencement of trial on September 26, 2002. The Court denied the Motion to Dismiss the indictment from the bench.
