PlaintiffAppellant Robert Newyear (“Newyear”) commenced a declaratory judgment against Defendani/Appellee The Church Insurance Company (“Church Insurance”) seeking a declaration that the comprehensive general liability policy issued to Newyear’s employer by Church Insurance provides defense and indemnity coverage for an action brought against Newyear by two women. The action was removed to the United States District Court for the Eastern District of Missouri.
