KRUEGER, Judge.

The appellant was tried and convicted of the offense of murder, and his punishment was assessed at confinement in the State penitentiary for two years:

The testimony shows that on the night of January 20, 1934¡ George Davis gave a dance in the second story of Nick Richter’s place of business. On a previous occasion when a dance was in progress at said place considerable disturbance was created by some of those who attended it.
