The pleadings and evidence in this case, with the exception of an amendment to the pleadings hereinafter noticed, will be found reported in the case of Lathrop v. White, 81 Ga. 29. The judgment was then reversed, and the theory made by the evidence which had not been submitted to the jury was directed to be submitted to them on the next trial. To meet this suggestion or direction, when the case came on for a second trial in the superior court, the plaintiff offered an amendment to her declaration, alleging, in substance, that her guardian, George H. White, had died pending…
