This case is presented upon certified questions from the Court of Civil Appeals of the First Supreme Judicial District under a statement, in part, as follows:

“This is a suit in trespass to try title to 80 acres of land situated in Harris County, Texas, brought by the Union National Bank of Houston, against II. B. Crowder and wife, Edna Crowder.

It is shown that H. B. Crowder, Sr., and wife owned as their community homestead a tract of land in Waller County, Texas; that on or about the 7th day of March, 1916, said…
