Appeal by the plaintiff from a judgment of the Supreme Court in favor of the defendant, entered in the office of the clerk of the county of Richmond on the 19th day of February, 1913, upon the dismissal of the complaint at the close of plaintiff’s case upon a trial before the court and a jury at the Richmond Trial Term.

Stapleton, J.:

The plaintiff appeals from a judgment entered against her, dismissing her complaint at the close of her case. The action was brought to recover damages for neglect of the defendant whereby the death of her intestate was caused.

The decedent was employed as an assistant to the engineer in the City Farm Colony, an institution established and maintained by the city of New York. His general work was to make minor repairs to the plumbing, heating and electrical apparatus about the buildings of the colony.
