This is an appeal, upon leave granted, from an order of the Court of Appeals affirming a judgment non obstante veredicto entered by Honorable Timothy C. Quinn, then presiding circuit judge of Tuscola county. The relevant facts are stated by the Court of Appeals, as follows : 1
