GOODRICH, Circuit Judge.

The plaintiff, Day, brought an action against The Pennsylvania Railroad Company based on the Federal Employers’ Liability Act, 45 U.S.C.A. § 51 et seq. Pennsylvania Railroad brought in Erie Avenue Warehouse Co. as a third-party defendant for indemnity or contribution. The Pennsylvania Railroad and the Warehouse Company are Pennsylvania corporations. Subsequently the suit between Day and the railroad was settled and the settlement approved by the court.
