The opinion in the former appeal, (Merck v. Merck, 83 S. C. 329), contains a detailed statement of'the issues in this action for partition. For the purposes of this appeal- it is sufficient to say that the title of the defendant, Mann, who- claims 'to be the exclusive owner of the land in dispute against the heirs of Blumer Merck, depends on the validity o-f an alleged deed from Blumer Merck to L.
