TOWNSEND, Circuit Judge.
This action was brought to recover $100,000, for damages for breach of contract. The material recitals in the said contract are summarized by the court in its charge to the jury as follows:
“The contract was entered into in the city of Mexico. It contains a recital that the plaintiff represented that he knew of the location of certain large and valuable asphalt deposits in Venezuela; that he believed them to contain more than 2,000,000 tons of crude asphalt, of a good quality for paving purposes, and that to the best of his knowledge and belief a concession could be…
