FACTUAL BACKGROUND

On July 27, 1999, the Commonwealth of Pennsylvania, Pennsylvania Game Commission, charged the de*518fendant with unlawfully killing a deer and an elk. Criminal charges were instituted by filing of citations in the office of District Justice Donald A. Wilhelm for the alleged unlawful killing of an elk on July 21, 1999, and for the alleged unlawful killing of a deer on July 22,1999.
