On May 27, 1997, Cynthia Ann Johnston and David Wayne Johnston sued Jeremy Todd Sample; Mike Richardson; Robert Norris; Mr. Mini Mart # 50 d/b/a Citgo Petroleum (“Mini Mart”); and Citgo Petroleum Corporation. The Johnstons sought, damages for injuries received by Mrs. Johnston as a result of an assault by Sample while she was on the premises of a store operated by Mini Mart. At the time of the alleged assault, Norris was the owner of the Mini Mart store and Richardson was the employee on duty at the store.
