SPEER, Justice.

This is an appeal from an election contest. Texas Public Utilities Corporation and B. F. Cherry, a resident citizen, property owner and tax payer of the City of Weatherford, Texas, hereinafter referred to as contestants, instituted this suit against G. A. Holland, the mayor of the City of Weatherford, Texas, Frank Fulgham, as county attorney of Parker County, Texas, Lawrence Edwards and Conrad F.
