The matters before the Court are the Motions For Summary Judgment on behalf of the Plaintiff and the Defendant. These findings and conclusions are based on a consideration of the record as a whole.
Plaintiff, the Resolution Trust Corporation (“RTC”), is a party to this proceeding in its capacity as the Receiver of Sooner Federal Savings and Loan Association and Sooner Federal Savings Association (“Sooner”).
