Pending before the Court is an appeal of an order and judgment of the Bankruptcy Court. 1 The primary issue in this Chapter 12 Bankruptcy appeal involves the attempt by the trustee (debtor-in-possession) to set aside allegedly preferential transfers created when the appellant Tri-County Trust Company (hereinafter Tri-County) unilaterally altered references to preexisting collateral agreements in future advance promis sory notes.
