In a proceeding pursuant to CFLR article 78 to review a determination of the Board of Standards and Appeals of the City of New York dated June 3, 2008, which denied an application for a special permit, the appeal is from a judgment of the Supreme Court, Kings County (Vaughan, J.), dated December 13, 2008, which granted the petition and annulled the determination.

Ordered that the judgment is reversed, on the law, with costs, the petition is denied, the determination is confirmed, and the proceeding is dismissed on the merits.
