The instrument by which the contract relations between the parties to this action were established has been a fruitful source of litigation in the courts of this State, and some of the rulings heretofore made have a controlling influence in the disposition of this .■appeal and will be referred to hereafter. This particular action was brought to recover moneys, a part under the provisions of that instrument and a part independently of its terms, that is to say, to recover royalties on a certain quantity of coal, which royalties are provided for by the terms of the instrument,…
