YANKWICH, District Judge.
Stewart Edward White, — to whom we shall refer as “White”, — as distinguished from the plaintiff, who will be referred to as such or as “the brother”, — was a successful writer of books on ethics and philosophy of a popular nature. Prior to his death in 1947, at Burlingame, California, he published, through well-known publishers, books with the titles: “The Unobstructed Universe”, “With Folded Wings”, “The Stars Are Still There”, “Anchors To Windward”, “The Road I Know”, “Across The Unknown”, “The Betty Book”.
