In the month of November, 1895, the plaintiff, as attorney for William H. A. Brown, administrator, commenced an action in the Supreme Court in the latter’s behalf against the executory of the estate of Cornelius Vanderbilt and various members of the Vanderbilt family. The ostensible object of the action was the recovery of the sum of $2,000,000, with interest from October 1, 1853, under a claim arising out of alleged transactions pursuant to a written agreement executed in 1851 between Vanderbilt and Brown’s intestate.
