1. This court’s judgment in American Oil Co. v. McCluskey, 118 Ga. App. 123, supra, having been reversed by the Supreme Court, McCluskey v. American Oil Co., 225 Ga. 63, supra, the judgment is vacated.

2. The defendant contends the trial judge erred in overruling the motion for judgment notwithstanding the verdict, motion for summary judgment, motion for directed verdict and motion for new trial on the general grounds.
