PONDER, Justice.
The plaintiff brought suit against the defendant seeking to recover $2,782.29 with 5% per annum interest and 10% as attorneys fees. The lower court rejected his demand and he has appealed.
In this suit the plaintiff is seeking to recover under three surety 'bonds in the amount of $2,000.00, $2,000.00 and $1?-000.00 respectively insuring the plaintiff against larceny, theft, embezzlement, forgery, misappropriation, wrongful abstraction, wilful misapplication and other fraudulent or dishonest acts that might be committed by Lawerence Ebarb, Fred Rivers, and Henry F.
