This is an appeal from the denial of post-conviction relief wherein the appellant sought to withdraw a plea of guilty to second degree murder. The appellant was originally indicted for first degree murder in 1967. He entered a plea of not guilty at his arraignment on November 22, 1967. On December 11, 1967, the appellant and two co-defendants appeared in Marion Criminal Court with counsel and indicated to the trial court that they wished to withdraw their previously entered pleas and plead guilty to lesser charges.
