The suit as originally brought was one by the Cisco & Northeastern Railway Company against R. C. Diefenderfer to recover certain indebtedness and to foreclose a mortgage lien. J. A. Clift intervened and sought judgment against defendant, Die-fenderfer, for amounts claimed to be due him, and for establishment and foreclosure of a statutory lien against property of Diefender-fer, which at the time was in the custody of J.
