Plaintiff in error, Edward Peyser, was convicted in the criminal court of Cook county, of abortion, and sentenced to the penitentiary for not less than one nor more than ten years, with a recommendation that he serve a minimum of one year, and a maximum of three years. The case was tried before the court without a jury.
