Distribution of fentanyl is a crime under K.S.A. 21-5705(a)(1) and by extension distribution of fentanyl causing death is a crime under K.S.A. 21-5430(b). 2. The law of causation has two core elements: cause-in-fact and legal causation. Cause-in-fact requires proof that, but for the defendant's conduct, the result would not have occurred.
