BOWMAN, Circuit Judge.
William A. Paul brought this action against his employer, Missouri Pacific Rail road (MoPac), under the Federal Employers’ Liability Act, 45 U.S.C. §§ 51-60 (1988) (FELA). Paul alleges that MoPac negligently exposed him to dangerously excessive levels of noise during his thirty-four years of service and caused him to suffer permanent hearing loss. A jury returned a general verdict for MoPac and the District Court 1 entered judgment on this verdict, dismissing the case with prejudice.
