This suit was filed in the Civil District Court by the surviving brother and sister of one Rodney Rhinehart, who was drowned on August 20th 1940 when he fell into the Mississippi River from a barge owned by his employer, T. Smith Son, Inc., which he was compelled to traverse in leaving the S.S. Ada O, where he had been engaged in work as a longshoreman. The action is against Rhinehart's employer to recover damages for his death under Article 2315 of the Civil Code as amended (the Louisiana death by wrongful act statute) or, in the alternative, for compensation under the Louisiana Employers'…
