MEMORANDUM AND ORDER DENYING CONFIRMATION OF DEBTOR’S AMENDED PLAN

FACTS AND NATURE OF THE CASE

Debtor filed a voluntary Chapter 13 petition on March 16, 1982. Both the original and amended plans purpose that secured debts be paid outside these proceedings. The original proposal was that four unsecured debts totaling $73,350.62 would receive ten per cent of their claims over a five-year period. Two of those unsecured obligations represent $70,690.62, or 96.37 per cent, of the total. Those same two debts were scheduled in a prior Chapter VII proceeding in which…
