MEMORANDUM OPINION AND ORDER
KANE, District Judge.
The complaint herein alleges that Joe Roy Sanchez was unmarried at the time of his death on June 2,1977. The complaint is brought by the personal representative of his estate as well as his brothers and sisters who are his sole heirs at law. It is alleged that defendant David Marquez, an officer of the San Luis, Colorado Police Department and a deputy sheriff of Costilla County, Colorado wrongfully assaulted and battered and then wrongfully shot and killed Joe Roy Sanchez.
