The plaintiff, the County of Hawaii at the relation and to the use of Annie Santana, brought an action in the circuit court of the fourth judicial circuit against Henry K. Martin and United States Fidelity and Guaranty Company for recovery upon the official statutory bond of Martin as sheriff of the County of Hawaii, the company being the surety on the sheriff’s bond.
