Appellant was convicted at the March term of the circuit court of Bollinger county, Missouri, of manslaughter and sentenced to imprisonment in the penitentiary for a term of five years. He appealed.
Appellant, at the time of the homicide, was operating a tavern and dance hall located at a crossroad near Lutesville, Bollinger county, Missouri. On Saturday night, April 18, 1943, the victim of the homicide, Elmer Holweg, was present at appellant's tavern where a dance was in progress.
