In this original proceeding in mandamus the petitioner, James E. Sams, a physician and surgeon, seeks to compel the respondent, Ohio Valley General Hospital Association, to appoint him to the medical staff of the respondent hospital or, in the alternative, to afford him a hearing with respect to his application for staff membership and the refusal thereof. On July 13, 1964, a rule was granted by this Court returnable September 8, 1964.
