Appeal (1) from an order of the Supreme Court at a Trial Term, entered October 12, 1976 in Delaware County, which granted defendant’s motion to set aside the verdict and, if that decision is not upheld on appeal, to reduce the jury award to $5,000, and (2) from a“ judgment of that court entered the same day which dismissed plaintiff’s complaint.
