MEMORANDUM OPINION AND ORDER

GOODWIN, District Judge.

Pending before the court are: (1) the defendants’ Motion for Summary Judgment [Docket 67]; (2) the plaintiffs Cross Motion for Summary Judgment [Docket 70]; and (3) the defendants’ Motion to Exclude Discovery and Evidence Relating to Jerry Lipscomb [Docket 72]. For the following reasons, the court GRANTS the defendants’ Motion for Summary Judgment and DENIES the plaintiffs Motion for Summary Judgment. Because the court’s order does not rely on the discovery and evidence relating to Jerry Lipscomb, the defendants’ Motion to Exclude is DENIED…
