OPINION

This is a motion and cross-motion for summary judgment brought by the parties pursuant to Rule 56 of Fed.R.Civ.P. The pertinent facts are undisputed.
Defendant Alfred M. Lilienthal [“Lilienthal”] is the author of a literary work entitled The Zionist Connection. On October 10, 1977, Lilienthal contracted with a publisher, Dodd Mead Co., Inc. [“Dodd Mead”], for the publication of his book.
