Defendant Danny Knight was convicted in a nonjury trial of driving while intoxicated in violation of RSMo § 577.010 (1986). Defendant had previously pled guilty to two alcohol related driving offenses. Defendant was sentenced to sixty days imprisonment or one hundred twenty days imprisonment with work release. Defendant raises two arguments on this appeal.
