Appeal by the defendant, by permission, from an order of the Supreme Court, Queens County (Gallagher, J.), dated July 29, 1985, which denied his motion for an order setting aside so much of a sentence of the same court (Brenner, J.), imposed January 6, 1978, as sentenced him to a term of imprisonment of 25 years to life upon his conviction of murder in the second degree.

Ordered that the order is affirmed.
