The plaintiff sustained injuries on May 18, 1952, when she fell on a sidewalk in the city of Watervliet. On February 6, 1953, an order was entered permitting her to serve a notice of claim pursuant to subdivision 5 of section 50-e of the *180General Municipal Law after the expiration of the ninety-day period specified in subdivision 1 of the section because of her mental and physical incapacity resulting from the fall.
