Appeal from •judgment of the General Term of the Supreme Court in the third judicial department, entered upon an order made September 10,1889, which affirmed a judgment in favor of plaintiff entered upon a verdict. The nature of the action and the facts, so far as material, are stated in the opinion. The motion of the defendant, the Acme Oil Company, for a nonsuit should have been granted, and a verdict on behalf of this defendant should have been directed.

The plaintiff brought this action to recover damages arising from the death of her husband, which occurred in the city of Albany, in September, 1885, and for which she claimed the defendants were liable. She recovered a judgment at the Circuit, which has been affirmed at the General Term, and from the judgment of affirmance all the defendants have appealed to this court.
