Error to a judgment of the Corporation Court of the city of Newport News, rendered October 31, 1900, whereby the plaintiff in error was sentenced to be hanged for murder of the first degree.

Plaintiff in error was convicted of murder in the first degree in tbe Corporation Court for the city of Newport News, and the case is before ns upon certain exceptions taken to the rulings of the court during the progress of the trial.

The first contention of plaintiff in error is, that the indictment was insufficient to warrant the verdict of murder in the *787first degree.
